LIMITATION OF LIABILITY

Kingston University shall have absolutely no liability in connection with the services including without limitation, any liability for damage to your computer hardware, data, information, Materials and business resulting from the Information or the lack of information available on the RiverOnline service.

Kingston University shall have no liability for:

1. Any loss caused, in whole or in part, by its actions, omissions, or negligence, or for contingencies beyond its control, in procuring, compiling, or delivering the Information;
2. Any errors, omissions, or inaccuracies in the Information regardless of how caused, or delays or interruptions in delivery of the Information; or
3. Any decision made or action taken or not taken in reliance upon the Information furnished hereunder.

Kingston University makes no warranty, representation or guarantee as to the content, sequence, accuracy, timeliness or completeness of the Information or that the Information may be relied upon for any reason. Kingston University makes no warranty, representation or guaranty that the Information will be uninterrupted or error free or that any defects can be corrected.

Under no circumstances shall Kingston University be liable for any losses or damages whatsoever, whether in contract, tort or otherwise, from the use of, or reliance on, the Information, with respect to the use of the Internet generally.

MISCELLANEOUS

1. Nothing in these Terms and Conditions is intended to or shall operate to create a partnership or joint venture of any kind between the parties. No party shall have the authority to act in the name or on behalf of the other party in any way.
2. These Terms and Conditions, together with the List of Exclusions, constitute the only Terms and Conditions that are relevant to the use of RiverOnline website.
3. If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable that shall not affect the other provisions of these Terms and Conditions - which should remain in full force and effect. Where any provision of these Terms and Conditions is found to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted, the provision in question shall apply with such modification(s) as may be necessary to make it valid and enforceable.
4. These Terms and Conditions do not create any right enforceable by any person who is not a Party.
5. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and subject to the exclusive jurisdiction of the English Courts.
